Terms of Service

The following are the general terms and conditions for using the tuk-tuk service offered by the company WWW.TUKANDFLOW.COM

Tours may not be modified, shortened, or simplified at the customer’s request, nor may they be conducted without returning to the starting point. The starting point may not be changed, nor may only a portion of the tour be booked at a reduced rate. Any improper use of the service—which could be construed as public passenger transport in passenger vehicles for the sole purpose of traveling from one place to another—is prohibited. Pets are also not permitted. It is important to note that the drivers operating the tuk-tuks are driver-assistants for tour groups, not tour guides.

Price, Duration, and Payment Policy

  • The price and duration of the service are those listed on the website at the time the service is contracted and are determined in accordance with the current General Rate Schedule (regarding services, taxes, and fees).
  • Simply reserving the service does not confer the right to use it. The service will be considered contracted once the customer has made payment through any of the methods made available to them.
  • The Customer agrees to be ready for the start of the service at the scheduled date and time and at the agreed-upon location. In the event of a delay, the contracted activity will be shortened based on the time lost, which may result in a change to the established route and the duration of the contracted service. The activity will be considered canceled if the delay exceeds 15 minutes, and in such a case, no refund of the amount paid will be issued.
  • The Customer agrees to pay the amount corresponding to any fines or penalties resulting from any violation of applicable law that may be incurred due to misuse or misconduct during the service, as well as any late payment fees incurred by the Customer and any judicial or extrajudicial costs that https://www.tuktandflow.com/ may have incurred as a result of the foregoing.

Cancellation and Refund Policy

  • If the contracted service is canceled with more than 24 hours’ notice, 100% of the amount paid will be refunded. Cancellations with less than 24 hours’ notice will not be accepted. If the reservation is canceled without notice, WWW.TUKANDFLOW.COM will not issue a refund.
  • In the event that weather conditions or other exceptional circumstances (road closures, demonstrations, traffic blockages, etc.) completely prevent the service from being provided, the amount paid will not be refunded.
  • If there is an error when booking the number of tuk-tuks on the website, and this is not noticed until the tour start time, WWW.TUKANDFLOW.COM will not issue a refund, as that availability cannot be booked by another customer.
  • No more than four people are allowed per vehicle; therefore, if more than four people show up after booking a single tuk-tuk, the booking cannot be canceled.
  • In the event of changes to the itinerary due to road closures or demonstrations on the day of the tour, the amount paid will not be refunded.

Code of Conduct

Customers are hereby informed that the driver reserves the right to refuse to begin or to terminate the service in the event of any violation or breach of the following rules:

  • The customer agrees to use the space occupied in the vehicle, as well as all other components, responsibly and to comply with the rules of the Highway Code.
  • It is prohibited to change the seat assigned to each participant at the start of the activity, as well as to exit the vehicle while the activity is in progress, unless otherwise instructed by the driver.
  • It is prohibited to stand up or make any movement likely to disrupt the normal operation of the vehicle and/or cause discomfort or damage to other vehicle occupants or other road users. It is therefore prohibited to extend arms, legs, and/or objects outside the vehicle.
  • Participants in the activity are required to be respectful toward other road users and pedestrians, refraining at all times from directing offensive remarks or insults toward them, as well as from shouting or screaming excessively, and maintaining a reasonable and appropriate noise level at all times.
  • It is the obligation of the vehicle’s occupants to care for and respect the furnishings on board the vehicle.
  • Participants agree, prior to and throughout the entire tour, to wear clothing appropriate for the type of activity being conducted. For example, the wearing of bikinis and/or thongs is prohibited if they lack any covering elements, as is going shirtless.
  • Any behavior likely to distract the driver is prohibited, as is attempting to take control of the vehicle.
  • Alcoholic beverages are prohibited on board the vehicle; non-alcoholic beverages are permitted, as are certain foods (snacks, etc.), provided they are not packaged in glass, cans, or ceramic containers.
  • Smoking is prohibited on board the vehicle.

Finally, please note that the above is not an exhaustive list; any unusual behavior that deviates from what is normally expected of other citizens may be included.

Recommendations

  • If the activity is taking place during the summer months, to avoid heatstroke and other adverse effects caused by high temperatures, participants are advised to bring a bottle of water in a plastic container and use sunscreen.
  • The vehicles do not have space to store suitcases, only small bags or backpacks, so we recommend checking the size of your belongings before boarding the vehicle.

Limitation of Liability

Since I am over 18 years of age and therefore of legal age, and since my participation in the activity to be carried out upon contracting the service is entirely voluntary, I acknowledge that I am solely responsible for my conduct and actions for the duration of my participation in the activity organized with the vehicle of WWW.TUKANDFLOW.COM, as well as for the conduct and actions of any minors in my care.

  • ​I am aware of and assume responsibility for the risks and hereby release the entity https://www.tukandflow.com/ from liability for any damage and/or physical injury that I or the minors in my care may suffer during the activity, resulting from any action or behavior that contravenes the provisions of the general terms of service.
  • I am aware of and assume responsibility for the risks and hereby release the aforementioned contracting entity from any liability for any damage and/or physical injury that I or the minors in my care may cause to third parties not involved in the activity during the course of the activity, resulting from any action that violates the provisions of the general terms of service.
  • I am aware of and accept responsibility for any complaints that law enforcement officers may file as a result of my actions or those of the minors in my care while aboard the vehicle or during the course of the contracted service.
  • I release https://www.tukandflow.com/ from liability if, due to circumstances beyond its control that prevent the scheduled route from being followed (e.g., traffic delays), the tour must take an unscheduled route or be shortened without prior notice to participants.
  • I release the aforementioned company from liability for any theft that may occur at the hands of a third party during the tour.
  • I release the service provider from liability in the event that the driver is forced to shorten the route or provide a service of shorter duration than contracted due to circumstances beyond their control, such as the tardiness or misconduct of all or some of the passengers (this clause also applies in the event that the service is contracted by different groups).
  • I acknowledge and accept responsibility for any object—personal or otherwise (cell phones, cameras, video cameras, etc.)—falling from the vehicle, whether the vehicle is in motion or stopped/parked.
  • I release the aforementioned company from any liability for any breakage or damage that may occur to any item, whether personal or not (cell phones, cameras, video cameras, etc.), resulting from its falling from the vehicle after it was handed over to company staff for the purpose of taking photographs, videos, etc.
  • I acknowledge and agree to follow, and ensure that the minors in my care follow, the instructions of the company’s staff regarding seating arrangements in the vehicle, in order to maintain order and the smooth running of the activity, especially when various unfamiliar groups are participating.
  • I acknowledge and accept responsibility for any damage or injury, whether to myself or to third parties participating in or unrelated to the activity, that I or the minors in my care may cause as a result of violating the prohibition against changing seats or exiting the vehicle while the activity is in progress.
  • The entity WWW.TUKANDFLOW.COM shall not be liable for any damage caused to passengers by third parties.

Acceptance

  • I have been informed and, therefore, authorize and agree that the company WWW.TUKANDFLOW.COM may use and/or publish my image and that of the minors in my care for advertising or marketing purposes. In the event of disagreement with this clause, the staff in charge of the activity must be informed, and they will record such refusal in writing (a document that must be signed by both contracting parties).
  • I have been informed and, therefore, authorize and agree that the company WWW.TUKANDFLOW.COM may use cameras in the vehicle for security and internal monitoring purposes. The images captured by these cameras will be used solely for internal statistical monitoring by WWW.TUKANDFLOW.COM and will be deleted after 30 days (as required by law). If you disagree with this clause, you must inform the staff in charge of the activity before contracting the service.
  • In the event of any doubt or misunderstanding regarding the terms of the contract, and in the absence of evidence to the contrary, the parties shall adhere exclusively to the written stipulations.
  • In the event of cancellation and/or reduction of the total duration of the activity due to causes beyond the control of the service provider, the latter shall not issue any refund of the money paid in advance.

Computer Processing of Personal Data

The Customer authorizes the automated processing of the personal data collected in this contract, which is necessary for the provision of the agreed-upon service, as well as for the offer and purchase of other products and services provided by the company. The Customer is hereby informed of their right to access, rectify, and, where applicable, delete their personal data by sending an email to administrador@tukandflow.com. Likewise, the Customer consents to WWW. TUKANDFLOW.COM to transfer their data to group companies, its franchisees, or other entities with which WWW.TUKANDFLOW.COM enters into collaboration agreements to better provide the electric vehicle tourism service, whether based in Spain or abroad, in compliance with Spanish legislation on the protection of personal data.

Applicable Law and Jurisdiction

This contract shall be governed by and construed in accordance with Spanish law. Any disputes arising from this contract between WWW.TUKANDFLOW.COM and the Customer shall fall within the jurisdiction of the Spanish courts and tribunals corresponding to the city where the contract was signed, to which both parties submit.

Confirmation

Upon confirmation of the reservation and, consequently, payment for the service, the customer expressly agrees to all of these General Terms and Conditions and accepts the privacy policy. If a person registers another person or persons, or is responsible for minors, they agree on their behalf to each and every one of these General Terms and Conditions.

Privacy Policy

Through our Privacy Policy, we inform you of the applicable terms of use for this site. Use of this site implies your full and unreserved acceptance of each and every provision included in this Legal Notice; therefore, if you do not agree with any of the conditions set forth herein, you must not use or access this site. We reserve the right to modify this Privacy Statement at any time. Your continued use of any portion of this site following notification or announcement of such modifications shall constitute your acceptance of such changes.
